Understanding United States immigration rules

Choosing an immigration path begins with the purpose of the application and the person’s circumstances. Immigrant visa categories concern permanent residence. Nonimmigrant categories cover temporary purposes, including visits, study and certain types of work. Eligibility and supporting documents differ by category.

A job offer is not a requirement for every visa category, and not every category is governed by the same numerical limits. The correct process also depends on whether a person applies for a visa abroad or may qualify for a benefit from within the United States.

Proposed legislation, enacted law and agency procedures are different things. A news report about a proposal does not mean that the change is already in effect. Before relying on information about eligibility, filing or timing, check the current rules for the specific category.
